DOT Marks 20th Anniversary of Transportation Drug Testing Law

 The U.S. Department of Transportation today marked the 20th anniversary of the statutory authority to conduct drug and alcohol testing for workers entrusted with the safe operation of our nation’s transportation system. The Omnibus Transportation Employee Testing Act, signed into law on Oct. 28, 1991, was enacted to reduce the abuse of alcohol and illegal use of drugs by employees such as pilots, airline mechanics, railroad engineers, truck drivers, bus drivers and subway operators. Since the law was implemented, illegal drug use among transportation workers has dropped 50 percent, while the risk of fatal accidents caused by alcohol use by truck and bus drivers has dropped 23 percent.

FMCSA Strike Force Targets Passenger Carriers

Did you know? - "The Federal Motor Carrier Safety Administration (FMCSA) is conducting another strike force. The current focus is passenger carrier safety. Over the next several days, federal, state and local law enforcement agencies and FMCSA safety investigators will be conducting thousands of bus safety inspections at popular travel destinations throughout the United States and its territories.

This isn’t the first time FMCSA has used a special strike force to target a specific group of carriers. Previous initiatives have focused on school bus, dump truck and hazmat companies.

The agency also uses the strike force approach to uncover companies that are violating a particular regulation. Recently, FMCSA announced that its second annual Drug and Alcohol Strike Force had nabbed 109 commercial bus and truck drivers and 175 carriers for violating the federal drug and alcohol rules."

, getting into transportation business is still relatively simple.  However, as of January 2011, the filing fees changed for all TCP applications except TCP-A certificate. Nothing-else changed except for the longer process times: TCP is still for "pre-arranged, single-load, charter services where the operator can only charge for time or mileage or a combination of time and mileage" - absolutely no flat or fixed fares for TCP service (flat rate fares are approved for "share-ride PSC" only). The following are the TCP filing fee changes as we read them for parties whishing to start and operate Limo, Charter, Livery, Tour and Roundtrip Sightseeing business in California ----

         DO YOU UNDERSTAND THE PUC's LLC QUESTIONNAIRE?
          WHO ARE YOUR MANAGERS? DO YOU HAVE EMPLOYEES?
If you want total control of your transportation business and or fear sharing managerial responsibilities, profit or loss with others, then an LLC structure may not work for you in the transportation industry.
          NOW, there is a wrong way and a right way to setup an LLC for a transportation business: they do in California. Talk to a transportation attorney, and or a professional specialized in transportation business.
         
if all your LLC members are managers, what are their duties? For instance, your marketing department may have different customer bases and or MARKET zones: does each marketing zone have an assigned manager? 
         
Remember, Workers Comp. matters are under the purview of the very specialized unit of the California Labor Commission called "Department of Industrial Relations (DIR)."  And, whether someone is an employee or not is best determined by the "Employment Development Department (EDD)". Now, it seems the EDD may treat non-managing members of an LLC as employees depending on the level of control a member has among other factors. Make sure to share company duties and responsibilities correctly or establish workers' comp. insurance for your LLC........

As you may already know, limousines are pre-arranged, exclusive, charter TCP - PSC - CAL-T - MCP - MC - USDOT#transportation services that customers may hire and pay on the basis of time of use (say $$ per hr, $$ per day...basis) or by the mile (mileage of use) or a combination time and mileage; and fares & charges are negotiable. In California limousines operate under a State issued permit or certificate prefixed "TCP" and suffixed by the letters "A" or "B" or "P": the suffix letters tell what type of service the limousine operator is authorized to provide (scope authority). Unlike "Taxi-cab & Jitney Licenses" TCP Licenses allow operations such as limousines to pick-up and drop-off passengers anywhere in the State of California. With limousine service the customer has exclusive use/control of the vehicle for the duration of the charter: limousine may go anywhere in the State to pick-up or drop-off the customer. Roundtrip Sightseeing Service TCP - PSC - CAL-T - MCP - MC - USDOT#is different from any other TCP charter service including but not limited to limousine & Livery services in the following regard: ●●●click and read on►
       
Shuttles, on the other hand, are "share-ride" passenger ground transportation services that are authorized to operate between specific, fixed, points: they are licensed to TCP - PSC - CAL-T - MCP - MC - USDOT#allow unrelated people going in the same general direction share-ride, and pay fixed, individual, fares approved by the state (fares are published in the operator's tariff, and must be made available to the public upon request). As common carriers they are required to serve any body seeking shared-ride service within the territory the carrier is authorized to serve. ACCESSIBILITY!
          For us, accessibility means "its available on-demand and affordable!" Very few individuals and corporations have ready access to services offered by transportation companies because they do not have the correct market  information about what these companies are licensed to do. Another difficulty in the past was that transportation companies sold their services under such trade names as airport shuttle, limousine, livery service, car-for-hire, tour-bus, etc. We want to sell their services from the point of view of their respective operating licenses:  this results in user-friendly services and allows for a more flexible transportation service systems. The impact the trade-names have on pricing will be removed and more services will become more affordable. Anyone should now be able to take a weekend limousine ride or impress a date without the excessive charges! 

WHO NEEDS TRANSPORTATION SERVICE?
          Anyone who chooses not to drive on any given time or day, or anyone who has a special occasion or event may need transportation service: share-ride or exclusive charter (Limo or Livery). It could be you or someone you know! Take a limousine or a car-for-hire (Liver, like a Taxi-without-boundaries) to the movie theater or anywhere you wish to go, including but not limited to airports, train stations, harbors; or use it for a date, a special occasion, an event or to just get-about-town.
          You may take the office party or meeting on an entertaining party-bus (charter/tour bus ride), or go where you will and see the sights & hear the sounds, or get that intimate feeling in a limousine. 
          And, how about transportation for infants and children to/fro daycare! Transport any adult, to/fro the doctor, on a non-medical event basis! These are all available services we have helped start and are still operating.
          You know,
in California, as with most other states/provinces, most luxury cars ,sedans, SUVs and the like (stretched or standard), are classified as limousines. Regular sedans, SUVs, Vans, RVs, Motorbikes (motorbikes with sidecar) and all other vehicles licensed to provide exclusive, single-load/single-party transportation service are generally known as "car-for-hire" services: they may provide similar comfort and services as limousines, but they are not limousines: they certainly are much better than Taxi-cabs and offer the same or similar comfort as limousines, but probably for a less fare than a limousine. Now, because they are licensed by the state to pickup/drop-off passengers anywhere in the state (and across city boundaries)  it is easy to see why we call them "Taxi-without-boundaries".
